1. What are Derm.city Online Services?

1.1 In the Terms:

"Derm.city Online Service(s)" are any Derm.city or other Derm.city-authorised Internet services, websites, products and/or software applications that enable you to access, view and/or listen to Derm.city Content.

Derm.city Online Services include the website at www.Derm.city, www.tohealtheskin.com, http://www.chronicle.ca/.

"Derm.city Content" means audio, video, text, images or other content made available by the Derm.city to you through Derm.city Online Services and may sometimes include content which is owned or controlled by third parties, which the Derm.city is permitted to make available to you through the relevant Derm.city Online Service.

 

2. How can I use Derm.city Online Services?

2.1 How you may use Derm.city Online Services

If you comply with these Terms of Use and with all relevant laws, you may use Derm.city Online Services to access, view, and/or listen to Derm.city Content for your personal and non-business use.

 

2.2 How you may not use Derm.city Online Services

 

General restrictions on how you may use Derm.city Online Services to access, view and/or listen to Derm.city Content

• • (a) You may not infringe or try to infringe the privacy or other rights of other Derm.city Online Services users. This includes you storing or trying to store personal data or usage details of other Derm.city Online Services users.

  • (b) You may not infringe any applicable law (for instance copyright law) when using Derm.city Online Services to access, view or listen to Derm.city Content.

  • (c) You may not subject the Derm.city Online Services and/or the Derm.city Content to any derogatory treatment or use them in such a way that would bring the Derm.city into disrepute, or cause the Derm.city to incur liability to any third party.

  • (d) You agree to use Derm.city Online Services and access, download, view and/or listen to Derm.city Content as supplied to you by the Derm.city and you may not, and you may not assist anyone to, or attempt to, reverse engineer, decompile, disassemble, adapt, modify, copy, reproduce, lend, hire, rent, perform, sub-license, make available to the public, create derivative works from, broadcast, distribute, commercially exploit, transmit or otherwise use in any way Derm.city Online Services and/or Derm.city Content in whole or in part except to the extent permitted in these Terms of Use, any relevant Additional Terms and at law.

  • (e) You may not directly or indirectly charge others for accessing, viewing or listening to any Derm.city Content, or commercialise or attempt to re-sell the Derm.city Content in any way, which includes advertising or selling any goods and services which offer Derm.city Content including any third party software applications.

  • (f) You may not directly or indirectly suggest any endorsement or approval by the Derm.city of a product or service (for instance, a personal website) or any non-Derm.city entity, product or content or any belief or opinion expressed within a product or service.

  • (g) You may not disrupt or try to disrupt Derm.city Online Services. You agree not to use Derm.city Online Services to distribute software viruses or other harmful programs, or use Derm.city Online Services to engage in harmful, harassing or otherwise objectionable activity, including activity inhibiting access to Derm.city Online Services by others.

  • (h) You may not harass or cause distress or inconvenience to any other person using Derm.city Online Services or transmit obscene or offensive content or disrupt the normal flow of dialogue within Derm.city Online Services, in particular, on Derm.city message boards and blogs.

     

 

3. Who owns or has rights in Derm.city Online Services and Derm.city Content?

3.1 Rights in Derm.city Online Services and Derm.city Content

All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Derm.city Online Services and Derm.city Content belong to the Derm.city and/or third parties (which may include you or other users). The Derm.city reserves all of its rights in Derm.city Content and Derm.city Online Services. Nothing in the Terms grants you a right or licence to use any trade mark, design right or copyright owned or controlled by the Derm.city or any other third party except as expressly provided in the Terms.

3.2 Digital Rights Management

So that the Derm.city can meet its obligations to third parties who own rights in Derm.city Content, the Derm.city may embed digital rights management security in Derm.city Online Services or Derm.city Content and/or use other content-protection measures. You may not adjust or circumvent or try to adjust or circumvent these technical measures.

 

4. How can I make contributions to the Derm.city?

4.1 The Derm.city may invite you to make, share or submit your own, original contributions to Derm.city Online Services. These Terms of Use and any Additional Terms for particular Derm.city Online Services set out the rules governing how you may do so and how Derm.city may use your contribution. Your contribution may include text, photographs, graphics, video or audio.

4.2 If you submit your contribution to Derm.city you must allow the Derm.city to use the material in your contribution in any way it may reasonably choose on a free-of-charge basis in any media throughout the world. Any contributions you make may be moderated by the Derm.city, which means they may be reviewed, edited and/or removed. Derm.city reserves the right to remove any of your contributions if the Derm.city believes that they do not comply with the Terms.

4.3 You grant Derm.city the right to change or edit the materials in your contribution for operational and editorial reasons. Derm.city may also share your contribution with trusted third parties, for instance with other users of Derm.city Online Services or, in the case of news-related material, Derm.city may share your contribution with its overseas partners (for instance reputable foreign news broadcasters).

4.4 Any copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material you contribute in any way including allowing others to use it.

4.5 You confirm that your contribution is your own original work, is not defamatory or unlawful and does not infringe anyone else's rights (including privacy rights) and that it complies with the Terms.

4.6 As part of your contribution, the Derm.city may ask you to provide some personal information. Disclosure of this information shall be subject to terms set out in the Derm.city. Derm.city will keep your personal information secure and will only use it for the purposes specified.

4.7 If you do not want to grant the Derm.city permission to use your contributions in accordance with the Terms, please do not share with or submit them to Derm.city.
